Chapter 3: Copyright
In addressing “the balance between public and private rights” (39) on the Internet, Willinsky proposes that more journals should utilize copyright laws like those developed by Lawrence Lessig and James Boyle, who created the Creative Commons. In utilizing the Creative Commons principles, journals like Kairos protect the interests of the author and the public.
Willinsky then argues that most authors are “indifferent” (46) to the copyright policies journals use when publishing academic research, and even though journals allow authors to submit articles to open e-archives, few take the opportunity to do so. According to Willinsky, only 15-20% of all published authors take advantage of the e-archives created by publishers. Willinsky's argument is clear and to the point: Journals need to rethink copyright policies; scholars need to know copyright policies and take advantage of open access e-archives.
